CONTEST RULES
"[WIN A DREAM FAMILY VACATION]"
IMPORTANT: PLEASE READ THESE RULES (THE "RULES") BEFORE ENTERING THE "WIN A DREAM FAMILY VACATION" CONTEST (THE "CONTEST") PRESENTED BY CLUB DE HOCKEY CANADIEN, INC. (THE "ORGANIZER"), THE WALT DISNEY COMPANY (CANADA) LTD. (THE "PRIZE PROVIDER" OR "DISNEY"). BY ENTERING THIS CONTEST, ENTRANTS CONFIRM THAT THEY MEET ALL OF THE ELIGIBILITY REQUIREMENTS SET OUT BELOW AND THAT THEY AGREE TO ABIDE BY THESE RULES WITHOUT RESTRICTION AND TO BE BOUND BY ALL DECISIONS OF THE ORGANIZER, WHICH ARE FINAL AND WITHOUT APPEAL REGARDING ALL ASPECTS OF THE CONTEST.
1. CONTEST PERIOD
1.1. The Contest begins on the 1 of December at 10:00 AM (EST) and ends on the 22 of December at 11:59 PM (EST) (the "Contest Period"). The date and time of receipt of entries will determine their eligibility for the Contest.
2. ELIGIBILITY
2.1. The Contest is open to legal residents of the province of Quebec who have reached the age of majority in the province of Quebec at the time they enter the Contest. Notwithstanding the foregoing, the Contest is not open to the employees, representatives and mandataries of the Organizer, the Prize Provider, their affiliates, subsidiaries, and associated companies, advertising and promotional agencies, promotional partners and suppliers of products or services related to the Contest, nor to any person domiciled with the aforementioned (whether related to the person or not) and any member of their immediate family (father, mother, brother(s), sister(s), children, legal or common-law spouse).
3. HOW TO PARTICIPATE
3.1. NO PURCHASE NECESSARY TO ENTER OR WIN.
3.2. To enter the Contest, entrants must, during the Contest Period, register for the Contest by completing the entry form accessible on the following website: fanclub.canadiens.com and create a Fan Club account as a parent/tutor for their child.
3.3. A limit of one (1) entry per Fan Club member to the Contest is permitted.
3.4. No automated entry devices, robots and/or other programs or software are permitted to enter the Contest. The Organizer cannot be held responsible for any late, lost, misdirected, incomplete, or corrupt entries, which may be rejected and will not entitle the entrant to participate in the Contest.
4. PRIZE
4.1. There is one (1) prize available to be won (the "Prize"). The Prize is a 5-night/6-day vacation package to the Walt Disney World Resort in Florida, which shall consist of the following:
• Up to four (4) round-trip coach airfares between the major gateway airport closest to the Winner's residence in Canada (the "Departure Airport") and the Orlando International Airport (the "Arrival Airport") in Orlando, FL (with possible layovers) on a Disney-selected carrier;
• Round-trip ground transfers or voucher(s) for round trip local ground transportation service for up to four (4) passengers between the Arrival Airport and the Walt Disney World Resort (ground transfers to be selected by Disney in its discretion);
• Room accommodations consisting of one (1) standard room (with a maximum of four (4) persons per room) for five (5) nights at a Walt Disney World Resort Hotel (location/category at the discretion of Disney), based on availability;
• Up to four (4) 6-Day Theme Park Tickets with Park Hopper Plus Option; and
• One (1) Disney Gift Card in the amount of six hundred U.S. dollars (USD$600.00) for the Winner, subject to restrictions.
Items not included as part of the Prize, which are the responsibility of the winner, include: meals; transportation from/to winner's residence to/from the Departure Airport; baggage fees; travel, health and medical insurance; parking fees; room service, laundry service, spa treatments; food or beverages; local and long distance telephone calls; merchandise and souvenirs; incidental expenses; tips, gratuities, service charges; income and other taxes; and all other costs and expenses not otherwise mentioned herein.
4.2. The approximate retail value of the Prize is CAD $ 13,591. The actual value of the Prize may vary depending on point of departure, seasonal fluctuations of hotel rates and airfares, and fluctuations in the currency exchange rates for U.S. Dollars. Any difference between the approximate retail value and the actual cost of the Prize will not be awarded.
4.3. It is possible that the Prize does not correspond to the photos/pictures used in advertising and promotional materials of the Contest, including, without limitation, advertisements on social media.
4.4. Any costs or expenses not specifically mentioned above as being included in the Prize will be the responsibility of the winner.
4.5. In no event shall the Organizer, the Prize Provider, their affiliates, subsidiaries, and associated companies, advertising and promotional agencies, promotional partners, suppliers of products or services related to the Contest, and their respective employees, officers, directors, agents, and representatives be required to award more prizes than indicated in these Rules or to award the Prize other than in accordance with these Rules.
5. PRIZE CONDITIONS
5.1. Prize is to be taken between March 1, 2025 and September 1, 2025. Departure date and accommodations are subject to availability; certain restrictions and block-out dates may apply.
5.2. Prize fulfillment and travel are subject to certain restrictions, air travel/flight availability, and certain hotel/room availability. The Prize must be booked through a travel agent as designated by Disney at least forty-five (45) days prior to arrival. Block-out dates apply. No extensions will be granted. Certain travel and lodging restrictions apply including airline carrier's regulations and conditions. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. Sponsor and Disney are not liable for any expenses incurred as a consequence of flight cancellation/delay.
5.3. Prize is for the winning person of the Contest and up to three (3) guests (each a "Guest"; collectively "Guests"; and, together with the winner, the "Group") of the winner's choosing. The Group must travel together on the same itinerary, and air transportation must be round-trip from/to the same Departure Airport/Arrival Airport (both as defined below), as chosen by Disney. Once selected by the winner, Guests cannot be changed without the express consent of Disney, which may be withheld for any reason.
5.4. Prize and Prize components may not be used in conjunction with any other promotion or offer, sold, traded, transferred, refunded, commissioned, redeemed for cash or rescheduled to dates other than as set forth above.
5.5. Any damaged, expired, lost or stolen airline tickets, theme park tickets, gift cards, or travel vouchers will not be replaced. Gift cards are not redeemable or exchangeable for cash (except as required by law) and are subject to all terms and conditions of use as established by issuer.
5.6. Winner and their Guests are responsible for having valid travel documents including government-issued identification and/or passports, as applicable.
5.7. Guests under the legal age of majority must be accompanied by a parent/legal guardian who must be at least the legal age of majority in their province or territory of residence and both will be deemed Guests of the winner (unless the winner is the Guest's parent or legal guardian).
5.8. Theme parks, attractions and other offerings are subject to availability, closures, change or cancellation without notice or liability. Park admission, offerings and ticket options are not guaranteed. Disney reserves the right to cancel any offering.
5.9. To visit the theme parks, theme park reservations via the Disney Park Pass system(https://disneyworld.disney.go....) AND valid admission are required for the same theme park on the same date for each person in the Group ages 3 and up. Reservations are subject to availability and are not guaranteed until a reservation is finalized. A park reservation must be made for each day of entry. The Park Hopper Option allows guests to visit more than one park per day. Each guest must make a park reservation via the Disney Park Pass system for the first theme park they plan to visit, and may take advantage of Park Hopper access after visiting their first theme park. 5.10. The Park Hopper Plus Option includes a certain number of visits to a water park or other Walt Disney World fun. Water parks subject to rehabilitation, seasonal and weather closures. Tee times are required for Disney's Oak Trail Golf Course and are subject to availability. FootGolf is available every Tuesday, Wednesday, Saturday and Sunday during select afternoon hours, subject to availability. Miniature golf valid for one round. Round must start prior to 4:00 PM. Only one miniature golf visit per day. ESPN Wide World of Sports admission valid only on event days; some events require an additional admission charge; there are no events on certain days; days and hours of operation of concessions, venues and attractions vary. 5.11. Photo identification and credit card in good standing or cash deposit may be required at check-in at the Walt Disney World Resort hotel for incidental charges (e.g., room service, use of telephone/IT services, laundry and all other optional extra services not provided in the Prize).
5.12. Officers, directors, and employees (and members of their household or immediate family, i.e., parents, children, spouse, siblings, grandparents, the "steps" of each and persons residing in such immediate family members' household) of Sponsor, The Walt Disney Company (Canada) Ltd., their respective parent, related, affiliated and subsidiary companies, their advertising, promotion and web design agencies, all other entities involved in the creation, administration, or fulfillment of the Contest and their respective successors and assigns are not eligible to enter or win.
5.13. The winner and Guests will be required to execute a liability/publicity release and waiver form prior to booking of any travel. The winner and Guests may be required to execute and return, where legal, publicity releases, which must be returned with the verification documents requested of winner. Failure to return the executed releases within the specified time period will result in forfeiture of the Prize.
5.14. Winner will not receive compensation for any component(s) of the Prize (including, without limitation, theme park tickets) that any participant(s) is unable to use for any reason, and such unused portion(s) of the Prize will be forfeited. If the winner chooses to bring less than the allotted number of Guests, the Prize will be awarded in increments suitable for the actual number of Guest(s) with no substitute prize or compensation provided to the winner.
5.15. The winner may not charge any Guest for participating in the Prize. The Prize cannot be transferred to another person, substituted for another prize, or replaced or exchanged for cash. The Prize must be accepted "AS IS", WITHOUT WARRANTY OF ANY KIND, either expressed or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose), being provided by Sponsor or Disney. Replacement of the Prize is permitted only at the Sponsor's sole discretion. In the event that the Prize cannot be awarded in accordance with these Rules, the Sponsor reserves the discretionary right to substitute such Prize with a prize of equal or greater approximate market value.
5.16. Prize Provider, its parent, related, affiliated , and subsidiary companies and each of their respective officers, directors, agents, employees and assigns shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and/or causes of actions that arise out of and/or in any way related to the Prize, the receipt, use and/or enjoyment of the Prize, any Prize related activity and/or the Contest. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Contest promotional materials and the terms and conditions of the official rules, the official rules shall prevail and govern.
5.17. Any and all disputes, claims and causes of action arising out of or connected solely with the Prize shall be governed and construed in accordance with the laws of the state of Florida, and in the event of any dispute, the winner and their Guest(s) irrevocably consent to the jurisdiction of the state and federal courts located in Orange County, Florida to resolve such disputes. Such claims shall be resolved individually, without resort to any form of class action, and all such claims shall be limited to actual out-of-pocket costs incurred, but in no event to include attorneys' fees.
5.18. Federal, provincial, state and local taxes, if any, relating to the Prize are the responsibility of the winner.
5.19. All elements of the Prize (including, without limitation, the theme park tickets) must be used by the Group on the same dates during the redemption of the Prize. Any portion of the Prize not accepted or used by the winner will be forfeited.
6. SELECTION OF WINNER
6.1. The winner will be selected by a random draw which will be made by the Organizer on December 23, 2024, at 10:00 AM (EST), at the offices of the Organizer located at 1275 Saint-Antoine Street West, Montreal, Quebec, H3C 5L2, among all eligible entries received during the Contest Period.
6.2. The odds of winning depend on the number of eligible entries received during the Contest Period.
6.3. The randomly selected entrant will be contacted by phone or email according to the information provided in their entry form. If the selected entrant cannot be reached within two (2) business days of the draw or if the Organizer determines, in its sole discretion, that the selected entrant do not meet all of the Contest conditions set out in these Rules, another draw will be held, and another entrant will be selected as a potential winner. This process will be repeated until an eligible winner is declared.
6.4. The Prize will be delivered to the winner, free of charge, at the address provided on their entry form.
6.5. In order to be declared winner and claim the Prize, the selected entrant must comply with the following requirements:
(i) Sign the declaration and liability waiver form (the "Declaration Form") that the Organizer will send him by email and return the said Declaration Form to the Organizer within forty-eight (48) hours of receipt;
(ii) Correctly answer a mathematical skill-testing question;
(iii) Comply with all instructions contained in the email sent by the Organizer announcing that he has been selected in the random draw; and
(iv) Meet all requirements set out in theses Rules.
6.6. Failure to comply with any of the above-mentioned conditions, or any other condition provided for herein, will result in disqualification of the selected entrant and a new draw will be held in accordance with these Rules in order to award the Prize. This process will be repeated until the Prize is awarded.
6.7. The information provided by the selected entrant, when contacted by the Organizer, must be complete and truthful.
7. CONFIDENTIALITY
7.1. Entrants' personal information is collected by the Organizer solely for the purpose of administering this Contest. Other informational or commercial communications from the Organizer may be received by the entrants if they agree to receive such communications by ticking the appropriate box while entering the Contest. By entering this Contest, entrants agree to the terms and conditions set forth in the Organizer's Privacy Policy. 8. LIMITATION OF LIABILITY
8.1. By entering or attempting to enter the Contest, any person releases and hold harmless the Organizer, the National Hockey League (NHL) and its member teams, the National Hockey League Players' Association (NHLPA), the Prize Provider, their affiliates, subsidiaries, and associated companies, advertising and promotional agencies, promotional partners, suppliers of products or services related to the Contest, and their respective employees, officers, directors, agents and representatives (collectively the "Released Parties") from any and all liability in connection with or arising out of the Contest, including, without limitation, in the event of any loss, damage, or injury related to the acceptance or use (or misuse) of the Prize, the administration of the Contest or the selection of the winner.
8.2. Without limiting the generality of the foregoing and for greater certainty, the Released Parties shall not be liable for:
(i) Any incorrect or inaccurate information, whether caused by the Contest website users or by any equipment or program utilized in connection with the Contest or associated with it, or by any human or technical error that may occur in the Contest entry process;
(ii) Any error, omission, interruption, deletion, defect, or delay in the operation of the Contest website or any transmission in connection with the Contest;
(iii) Any communication line failure, theft, destruction, or unauthorized access to, or alteration of, entries;
(iv) Any problem, failure, or malfunction of any computer component, network, communication line, server, or software, any loss or lack of network communication, any technical problems or traffic congestion on the Internet or any website, any transmission that is faulty, incomplete, incomprehensible, or erased by any computer or network, or any other combination of the foregoing which may limit or prevent any person from entering the Contest;
(v) Any damage to a third party's computer related to or resulting from entering, or downloading material for the Contest;
(vi) Any injury, damage, harm, or loss arising out of the participation in the Contest or the awarding, acceptance, or use (or misuse) of the Prize.
8.3. The Released Parties shall not be held responsible if the Contest cannot be run as planned for any reason whatsoever, including, without limitation, infection by computer viruses, bugs, errors, tampering, unauthorized intervention, fraud, technical failures, or any other causes that corrupt or affect the administration, security, equity, integrity, or proper conduct of the Contest.
9. USE OF PERSONAL INFORMATION
9.1. By entering the Contest, entrants consent to the collection, use and disclosure of their personal information by the Organizer for the purposes of administrating the Contest, delivering the Prize, and disclosing the winner. In addition, by entering the Contest, entrants confirm they comply with all the terms and conditions set forth in these Rules and consent to the disclosure, publication and use of their name, place of residence, photograph, likeness, voice and statement, without compensation or notice, for publicity, marketing and/or informational purposes in any media or format (including the Internet), for an indefinite period of time and without geographic limitation, in connection with this Contest or similar contests in the future, and agree to sign any document related to this undertaking or deemed necessary by the Organizer.

10. GENERAL CONDITIONS
10.1. Decisions. Any decision of the Organizer or its representatives relating to this Contest is final and without appeal.
10.2. Ownership. All entry forms, Declaration Forms, and other documents or materials sent to the Organizer in connection with the Contest (collectively the "Entry Material") become the property of the Organizer upon submission and will not be returned to the entrants and/or the winner.
10.3. Verification. Entry Material is subject to verification by the Organizer. Any Entry Material which is incomplete, illegible, incomprehensible, mutilated, fraudulent, registered or transmitted late, bearing an invalid email address or telephone number, not including the correct answer to the mathematical skill-testing question or otherwise non-compliant will be void and will not entitle the entrant to participate in the Contest.
10.4. Disqualification. The Organizer reserves the right, at its sole discretion, to cancel one or more entries of a person or disqualify any person from this Contest and/or exclude such person from any future contest or promotion held by the Organizer if any such person participating in the Contest or attempting to participate in the Contest (i) fails to comply with any of the conditions set forth herein and any conditions of the Canadiens Fan Club (ii) enters or attempts to enter the Contest by using any means that is contrary to these Rules or that is unfair to the other entrants (for example: use of automated equipment to participate in this Contest, hacking, number of entries exceeding the permitted limit, etc.); or (iii) is suspected of having directly or indirectly tampered with the Contest or of having made a false declaration.
10.5. Course of the Contest. Any attempt by an entrant or any other individual to deliberately damage any component related to the Contest, including, without limitation, the Contest site, tamper with the entry process or undermine the legitimate operation of the Contest is a violation of criminal and civil laws. Should such an attempt be made, the Organizer reserves the right to reject any entry of such person, to refer such person to the appropriate legal authorities and to seek remedies and damages to the fullest extent permitted by the applicable laws.
10.6. Entrant identification. For the purposes of these Rules, the entrant is the person whose name appears on the Club 1909 account used to enter the Contest. It is to this person that the Prize will be awarded if he is selected and declared a winner. The Organizer reserves the right to require identification before awarding the Prize.
10.7. Operation of the website. The Organizer does not guarantee in any way that the Contest website or any site linked to it will be accessible or functional without interruption during the Contest Period or that it will be error-free.
10.8. Modification of the Contest. The Organizer reserves the right, at its sole discretion, to cancel, terminate, modify or suspend, in whole or in part, the Contest at any time if an event or human intervention occurs that could alter or influence the administration, security, impartiality or conduct of the Contest as contemplated by these Rules.
10.9. End of participation to the Contest. In the event that the computer system is unable to record all entries in the Contest during the Contest Period, for any reason whatsoever, or if participation in the Contest should be terminated, in whole or in part, before the end date provided for in these Rules, the draw may be made, at the discretion of the Organizer, from among entries duly registered during the Contest Period or, where applicable, until the date of the event that terminated participation in the Contest.
10.10. Communication with entrants. No communication or correspondence will be exchanged with entrants except as provided for in these Rules or in connection with the administration of the Contest, at the initiative of the Organizer, unless entrants have otherwise consented.
10.11. Divisibility of paragraphs. If any section of these Rules is declared or held by a court of competent jurisdiction to be illegal, unenforceable or invalid, then that section shall be deemed void, but all other unaffected sections shall be enforced to the fullest extent permitted by law.
10.12. Language. In the event of a discrepancy between the French and English versions of these Rules, if an English version is available, the French version shall prevail.
10.13. Gender. The masculine gender is used without discrimination, for conciseness purposes only.
10.14. Applicable Laws. Except for disputes, claims or causes of action relating to the use of the Prize by the winner or Guest(s) as provided in Section 5.17 above, the Contest is governed and construed exclusively in accordance with the laws of the province of Quebec, without regard to the provisions relating to conflicts of laws.
