Scotiabank Education Savings Plan Contest
Contest Rules
The Contest is held in the Province of Quebec by the Montreal Canadiens (hereinafter: the "Contest Organizer"). It starts at noon on November 6, 2018 (Eastern time: ET) and ends at 11h59 on October 31, 2019 (ET) (hereinafter: the "Contest period").
NO PURCHASE NECESSARY TO ENTER OR WIN. The Contest is open to Club 1909 members who reside in Quebec and who have at least one child that is a member of the Canadiens Fan Club. This Contest is not open to (i) employees of Scotiabank or the Canadiens, or of their advertising and promotional agencies as well as their mandataries, nor those of their affiliated companies, subsidiaries, associated companies, and (ii) persons residing under the same roof as those mentioned above in (i), and (iii) members of the immediate family of the persons mentioned under (i) and (ii) above. For the purpose of the present Contest Rules, immediate family refers to the father, mother, brother, daughter, common law and legal spouse.
How to Enter
To enter the Contest, the parent must be a 1909 Club member and register his/her child either in the basic Canadiens Fan Club package or in one of the other packages (newborn, ages 1-4 or ages 5-12) by following the procedure to this effect during the Contest period which appears on the website. Certain fees apply to paying Fan Club subscriptions. Once subscription is completed, the person must then register in the Contest. He/she can enter on the www.fanclub.canadiens.com/en/contests. If the person is not already a Club 1909 member and therefore cannot register his/her child in the Fan Club, he/she must first open a Club 1909 account in order to register in the Contest. The Contest will be advertised on the Montreal Canadiens Facebook page and in the Canadiens Fan Club newsletter. By clicking on the link found in the Facebook posts and in the Contest advertisements, they will be redirected to the Contest page.
If your child is already a Canadiens Fan Club member, you can proceed directly to register for the Contest. However, as all Canadiens Fan Club subscriptions end on June 30 of the year, you will have to register your child again for the package of your choice for the 2019-2020 season in order to be able to continue to participate in the Contest as of July 1, 2019.
Each monthly draw is independent from the others and entries for each draw will not be carried forward to the next monthly draw. Therefore, entry in the first draw only counts for that draw and so forth. The person who wishes to enter many draws must follow to procedure applicable to everyone of these draws.
Odds of winning. By entering the Contest as a purchaser of a paying package among those mentioned above, you get two entries in the next monthly draw when you enter. When you enter as a no fee package subscriber, then you get one entry in the next monthly draw. However, in that case, you can get an additional entry by 1) sending a 50 words or more email to wi@canadiens.com explaining why you would like to win a prize; 2) indicating in your email the name of two of the products offered by Scotiabank and, 3) indicating therein your name, surname, Club 1909 membership number, complete address including your postal code, phone number including your area code, email address as well as the name of one of your children whose Canadiens Fan Club account is linked to your Club 1909 account and who could benefit from the prize. Your email must be received no later than 11h59m59s, on the last day of the month which precedes the month in which the next draw is to be held in order to be eligible for that draw. Your email will be verified by the Contest Organizer and if it is compliant, you will get a second entry for the next draw. N.B. The two Scotiabank products identified in your email must be different from those mentioned in your other emails, as the case may be.
Limit. For each draw, there is a limit of one (1) registration in the Contest per Club 1909 member and per child whose Canadiens Fan Club account is linked to his/her Club 1909 account. Each entry is valid for one draw only.
Prizes to be won. In all, there are thirty-six (36) prizes to be won, each consisting of a $1,000 deposit in a Scotiabank Registered Education Saving Plan.
Random draws. There will be a monthly draw for three (3) of the above described prizes on the first Monday of each month starting December 3, 2018 up to November 4, 2019 from among all entries received within the preceding month and no later than 11h59m59s on the last day of the month that precedes the month in which the draw is held. All draws will take place around 2 p.m. at 1275 St-Antoine West (3rd floor) in Montreal. For example, if you enter on May 3, 2019, your entry will count for the June draw and not for the draw to be held on Monday May 6 since only entries made during the month of April will be valid for that draw.
Winner selection. If the entrant selected at random cannot be reached within three (3) business days following the draw date or if the Contest Organizer determines (at its sole discretion) that the selected entrant does not meet all the Contest requirements as set in these Rules, another draw will take place. This procedure will be followed until an eligible entrant is declared the prize winner. To be so declared, the entrant must confirm his/her acceptance and compliance with the Contest Rules and release the Montreal Canadiens, Club 1909, Scotiabank, the National Hockey League and member teams, the National Hockey League Players' Association, their respective employees, directors, persons in charge, officers, affiliated companies, parent companies, representatives, subsidiaries, professional advisers and advertising and promotional agencies (collectively the "Released Parties") from any and all liability in connection with or arising out of this Contest, including, without limitation, any liability regarding acceptance or use of the prize awarded and any tax implications whatsoever, conduct of the Contest and selection of winner. Winner will have to sign a declaration form (the "Declaration form") that he/she will receive by email from the Contest Organizer on the same day and he/she must email back a scanned version of it to the Contest Organizer within five (5) business days following its receipt. The fact of being declared a winner is dependent upon signing the Declaration form and is also dependent on the person correctly answering, without assistance, the mathematical skill-testing question appearing on the said form. The winner must confirm having met all eligibility requirements as set in these Rules and also confirm the name of the child to the benefit of which the amount must be deposited in an RESP as well as the relationship with the child.
Failure to comply with the terms and conditions mentioned above or any of the terms and conditions mentioned in these Rules will result in the disqualification of the entrant's selected entry. In such a case, the Contest Organizer may, at its sole discretion and time permitting, hold a new random draw among the other eligible entrants for the same draw in accordance with these Rules to name a new prize winner.
Prize acceptance. Prizes must be accepted as they are described in the present Rules and cannot be totally or partly transferred to another party, substituted for another prize or traded in for money, subject to what is otherwise provided for in these Rules. Winner agrees to go to a Scotiabank branch so that the necessary steps may be taken in order that the amount can be deposited in an RESP account at Scotiabank.
Prize substitution. In the event where, for reasons not related to winners, it would be impossible for the Contest Organizer to give a prize (or part of a prize) as it is described in the present Rules, it reserves the right to give a prize (or part of a prize) of the same nature and of equivalent value or, at its sole discretion, the prize value (or portion thereof) as indicated in the present Rules in cash.
Verification. Documents submitted to enter the Contest as well as Declaration forms are subject to verification by the Contest Organizer. Any such documents may be rejected if it is incomplete, illegible, mutilated, fraudulent, registered or submitted late, if it bears an invalid email address or phone number, does not bear the correct answer to the mathematical skill testing question or is, in any other way, non compliant to the present Rules.
Contest rollout and disqualification. Before a prize is given out, the Contest Organizer will make the necessary verifications. The Contest Organizer reserves the right, at its sole discretion, to disqualify any entrant and void any entries of that entrant in the present Contest and/or to exclude it from any other Contest or promotion the Contest Organizer runs: 1) if the entrant fails to meet the terms and conditions as set forth in these Rules; 2) if entrant entered or attempted to enter using means contrary to these Rules or that would be unfair to other entrants (for example: number of entries above the limit allowed); or 3) if entrant is suspected of having directly or indirectly tampered with the running of the Contest or of having made a false declaration.
Limitation of responsibility: contest operation. The Released Parties are not liable for any faulty computer components, software, or line of communication, or for the loss or absence of network communication capability, or for any faulty, incomplete, incomprehensible, or erased computer or network transmissions that make it difficult or render an individual unable to enter the Contest.
Limitation of liability: Contest entry. By entering or attempting to enter this Contest, all persons entering or attempting to enter this Contest release the Released Parties from all liability for any damage they may suffer by entering or attempting to enter the Contest.
Disturbing Contest running. Any attempt by any person to deliberately damage any component associated to participation in the Contest or the administration thereof or to sabotage the legitimate running of the Contest constitute a violation of civil and criminal law. Should any such attempts take place, the Contest Organizer reserves the right to refer the matter to the appropriate legal authorities and seek damages to the fullest extent permitted by law.
Contest Modification. The Contest Organizer reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend this Contest in whole or in part should human intervention or an event take place that could modify or affect the administration, security, impartiality or conduct of the Contest as provided herein, subject to approval by the Régie des alcools, des courses et des jeux du Québec, if required.
End of Contest. In the event that the computer system is unable to register all Contest entries during the Contest period, for any reason whatsoever, or Contest must end in whole or in part before the date indicated herein, winner may be drawn, at the discretion of Contest Organizer, from among the eligible entries received during the Contest period or, as the case may be, up to the date of the event that ended the Contest.
Authorization. By taking part in this Contest, any prize winner authorizes the Contest Organizer and the Scotiabank as well as their respective representatives to use, if required, their name, photograph, likeness, statement about the prize or about the Contest, place of residence and/or voice for advertising purposes or any other purpose related to the activities of the Montreal Canadiens and the Scotiabank, in all media, without any territorial or time limitations and without compensation of any kind or prior approval. More specifically and without restricting the foregoing, winner accepts to have his/her picture taken for advertising and promotional purposes to be broadcast and posted on any Montreal Canadiens' website, at the Bell Centre, on any television station and in all media in relation to the present Contest or future editions of such or any Contest run by the Montreal Canadiens.
Communication with entrants. No communication or correspondence will be exchanged with entrants except in accordance with these Rules or for the administration of the Contest, unless participants have otherwise given their consent.
Use of Personal Information. By participating in the Contest, each entrant consents to the collection and use of his or her personal information provided to enter the Contest by the Contest Organizer and its advertising and promotion agencies, for the sole purposes of administering the Contest in accordance with the Contest Organizer's privacy policy, unless the entrant has authorized use of his/her personal information for other purposes.
Entrant identification. For the purposes of these Rules, the entrant is the Club 1909 member whose entry is drawn.
Ownership. Documents used within the Contest are the property of the Contest Organizer and will not be returned to entrant under any circumstances.
Decisions by the Contest Organizer. Any decision by the Contest Organizer or its representatives regarding this Contest is final and binding, subject to any decision by the Régie des alcools, des courses et des jeux du Québec with respect to any matter under its jurisdiction.
Disputes. Disputes about the organization or conduct of a promotional contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Disputes regarding the awarding of prizes may be submitted to the Régie only for the purposes of helping the parties reach a settlement.
Severability. If a section of these Rules is declared or deemed illegal, unenforceable, or invalid by a court of competent jurisdiction, that section will be considered null and void, but all other sections that are not affected will be enforced to the extent permitted by law.
Gender. Use of the male gender in this document is only intended to make reading easier and is done without any discrimination
